SCOTUS Dismisses Case, Mifepristone Remains Accessible

Today, we celebrate a landmark victory for abortion access and scientific integrity. The Supreme Court of the United States has dismissed the FDA v. Alliance for Hippocratic Medicine case on standing, ensuring that mifepristone remains available as it is today, nationwide. This decision is a testament to the power of evidence, science, and the unwavering advocacy of our community.

Dr. Jamila Perritt, ob/gyn in Washington DC and President & CEO of Physicians for Reproductive Health responds:

“Today’s ruling is in alignment with medical evidence and with what our communities need and deserve in order to live full, healthy lives. Regardless of what happens in the court, abortion care, and medication abortion care specifically, will always be a part of that. This ruling is especially significant as we approach the second anniversary of the Supreme Court’s overturning of Roe v. Wade, the decision that catalyzed the rapid unfurling of dangerous bans and restrictions on abortion. Today’s decision reflects and acknowledges the dire short- and long-term consequences abortion restrictions impose and demonstrates a valuing of science, medical expertise, and centering the needs of our communities. The Court’s dismissal on standing allows us to center the medical recognition of the facts is a powerful affirmation of what we have always known: mifepristone is a safe and essential medication, and there is no legitimate medical or scientific reason why access to mifepristone should be limited.

“Today we celebrate this meaningful victory thanks to our community’s relentless advocacy. Together, we fought tirelessly to ensure access to mifepristone because of its critical role in reproductive health care and its importance in expanding abortion access for our community members, especially those living at the intersections of systemic oppression disproportionately harmed by abortion bans and restrictions. This victory is not just for doctors and researchers who have built the body of medical evidence to support its use, but for every person who has navigate the complex and hostile landscape of abortion access. It underscores the importance of continuing our collective efforts to expand access and uphold everyone’s fundamental right to full-spectrum reproductive health care.

“While we celebrate today, we know there is much work to be done. We will continue fighting for comprehensive reproductive health care, listening to our community, and advocating for policies grounded in science, humanity, and the best medical practices. We will not rest until everyone has unfettered access to the care they deserve, free from political interference.”
